TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) are a legal agreement between you and Viciny (“Viciny,
” “we,

” or “our”) governing your access to and use of Viciny’s apps, websites, APIs, and related services.
By creating an account or using the Services, you agree to these Terms.
1. Who May Use Viciny
You may use the Services only if:
You can form a binding contract under applicable law.
You are not prohibited from using the Services under applicable law or sanctions.
You meet the minimum age requirement in your country (at least 13, or older where required by
local law).
During account creation, you will be asked to enter your date of birth. If the date of birth you enter
indicates you do not meet the applicable minimum age, you will not be able to complete account
creation. By creating an account, you also confirm that the information you provided, including your
date of birth, is accurate. If you are under the age of majority in your jurisdiction, your parent or legal
guardian must review and agree to these Terms on your behalf.
2. Your Viciny Account
You agree to provide accurate information and keep your credentials secure. You are responsible for
all activity under your account. We may require identity, age, or business verification where necessary
for safety or legal compliance.
3. Changes to the Services and Terms
We may update the Services and these Terms periodically. Material changes will be notified through
the app, website, or email. Continued use of the Services after updates signifies your acceptance of
the new Terms.
4. Privacy
Your use of the Services is also subject to the Viciny Privacy Policy, which describes our data collection
and usage practices.
5. Content on Viciny
5.1 Your Content. You retain ownership of Your Content. To operate the Services, you grant Viciny a
worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and distribute Your
Content. This license ends upon deletion, except where retention is required for legal, security, or
technical reasons.
5.2 Platform and Third-Party Content. Viciny branding and software are owned by Viciny or our
licensors. You may not copy, reverse engineer, or create derivative works of our Services without
permission.
6. Community Rules and Safety
You may not use the Services to violate laws, harass others, share illegal content, infringe on rights, or
interfere with service security. Unauthorized use of bots or scraping is prohibited.
Reporting and blocking: To help keep our community safe, the Services provide tools that let you:
Report objectionable content or behavior: Use the in-app Report User / Report Issue feature to
flag posts, messages, comments, profiles, or other user behavior that you believe violates these
Terms or our community guidelines, directly from within the app.
Block other users: Prevent a specific user from contacting you, viewing your content, or
interacting with you on the Services, using the in-app Block User feature.
We review reports and take appropriate action, which may include removing content, restrictingfeatures, or suspending or terminating accounts, consistent with Section 7 below.
7. Live Content Rules
Because live streaming happens in real time, additional rules apply to live content on the Services:
Immediate termination: Viciny may immediately terminate any live stream that violates these
Terms or our community guidelines, without advance notice, to prevent ongoing harm.
Reporting or blocking the broadcaster: The app does not currently offer a dedicated option to
report a live stream itself. However, users can report or block the user conducting the live stream
directly from within the app, including while the stream is actively broadcasting, using the same
Report User and Block User tools described in Section 6.
Review and enforcement: Reports involving live content or broadcasters are prioritized for
expedited review given the real-time nature of the content, and may result in the stream being
ended, the broadcaster’s account being restricted, or other enforcement action.
8. Enforcement and Moderation
We may remove content or disable accounts that violate these Terms or threaten user safety. Where
required by law, we may provide notice and appeal options for moderation actions.
9. Copyright and IP Complaints
If you believe your rights are being infringed, contact us with proof of ownership. We may remove
infringing content and suspend repeat offenders.
10. Paid Features and Billing
Viciny may in the future offer paid features, subscriptions, or in-app purchases (such as virtual coins).
As of the Last Updated date above, in-app purchases are not implemented and no payment
feature is functional; any payment-related screens currently visible in the app are placeholders
only, and users cannot make purchases through the Services at this time.
If and when paid features are enabled, you will be notified, and the following will apply: you authorize
us to charge applicable fees and taxes, subscription renewals will continue until canceled, and unless
required by law, fees will be non-refundable. Where purchases are made through Apple’s in-app
purchase system or Google Play’s billing system, those purchases will also be subject to the applicable
terms of the Apple Media Services Terms and Conditions or the Google Play Terms of Service,
respectively, including their respective refund, billing, and cancellation policies.
11. Service Availability and Termination
We strive for reliability but do not guarantee uninterrupted service.
Account deletion: You may delete your account at any time directly through the app’s in-app
settings (Settings > Account > Delete Account), without needing to contact support. Upon deletion,
your account enters a 30-day grace period before permanent deletion, as described in the Viciny
Privacy Policy. During this period your account is deactivated and your content is hidden from other
users. If you do not reactivate within 30 days, your account and all associated content — including
photos, videos, and live stream recordings — are permanently deleted, subject to limited exceptions
for legal, security, or technical reasons.
We may suspend access if you violate these Terms or if legally required.
12. Disclaimers and Limitation of Liability
Services are provided “as is” without warranties. To the fullest extent permitted by law, Viciny is not
liable for indirect or consequential damages. Our aggregate liability is limited to the amount paid in
the last 12 months or USD $100.
13. Indemnification
You agree to indemnify Viciny against claims or losses arising from your use of the Services, Your
Content, or your violation of these Terms.
14. Dispute Resolution and Governing LawDisputes will be governed by the laws of New Jersey. We agree to attempt informal resolution first.
Except where prohibited, disputes will be resolved through binding individual arbitration, and you
waive the right to participate in class actions.
Right to opt out: You may opt out of this arbitration agreement and class action waiver by sending
written notice to support@viciny.com within 30 days of the date you first create a Viciny
account. Your opt-out notice must include your name, the email address associated with your account,
and a clear statement that you wish to opt out of arbitration. If you opt out, disputes between you and
Viciny will be resolved in accordance with the remainder of this Section 14, except for the arbitration
and class action waiver provisions, and will instead be subject to the courts located in New Jersey,
without prejudice to any other rights you may have under applicable law, including the laws of your
state or country of residence.
